Skeleton : the structure and the mandatory points are there, the final wording must be reviewed by a lawyer.
1. Purpose
These terms govern the use of the Guide Louis, a platform for collecting and distributing customer reviews published by the company L'autre Instant, both by the merchants who subscribe to it and by the consumers who submit a review.
2. Submitting a review
A review can be submitted in three ways : following an invitation sent after an order forwarded by the shop or the till, following an invitation addressed by name by the merchant, or freely from a QR code or a collection link. Every published review states which of these three routes produced it, and only the first two allow the "verified purchase" label.
A freely submitted review is only published after its author's email address has been confirmed. In every case, the author may edit or delete their review at any time, with no time limit and without having to justify themselves.
3. Publication and moderation
Reviews are published whether they are positive or negative. No mechanism allows a review to be withdrawn because of its rating. The grounds for removal are exhaustively listed in our charter.
4. Merchant obligations
The merchant undertakes to forward only genuine orders and the contact details of their authors. It is their responsibility to offer their customers the opportunity to object to marketing at the moment they collect their contact details, on their own checkout. That obligation is theirs and we cannot stand in for it.
They refrain from any reward in exchange for a review, as well as from any selective solicitation based on the customer's presumed satisfaction.
5. Suspension
An account may be suspended in the event of a breach, in particular the forwarding of fictitious orders or a marked deterioration in the deliverability of sent messages. Reviews already published survive the closure of an account.
6. Liability
We act as host of the reviews within the meaning of the European Digital Services Act. We guarantee no volume of collected reviews and no commercial outcome.
7. Governing law
French law. Competent jurisdiction to be specified.
